Background: Clinical genomic implementation studies pose challenges for informed consent. Consent forms often include complex language and concepts, which can be a barrier to diverse enrollment, and these studies often blur traditional research-clinical boundaries. There is a move toward self-directed, web-based research enrollment, but more evidence is needed about how these enrollment approaches work in practice. In this study, we developed and evaluated a literacy-focused, web-based consent approach to support enrollment of diverse participants in an ongoing clinical genomic implementation study. (...) Methods: As part of the Cancer Health Assessments Reaching Many (CHARM) study, we developed a web-based consent approach that featured plain language, multimedia, and separate descriptions of clinical care and research activities. CHARM offered clinical exome sequencing to individuals at high risk of hereditary cancer. We interviewed CHARM participants about their reactions to the consent approach. We audio recorded, transcribed, and coded interviews using a deductively and inductively derived codebook. We reviewed coded excerpts as a team to identify overarching themes. Results: We conducted 32 interviews, including 12 (38%) in Spanish. Most (69%) enrolled without assistance from study staff, usually on a mobile phone. Those who completed enrollment in one day spent an average of 12 minutes on the consent portion. Interviewees found the information simple to read but comprehensive, were neutral to positive about the multimedia support, and identified increased access to testing in the study as the key difference from clinical care. Conclusions: This study showed that interviewees found our literacy-focused, web-based consent approach acceptable; did not distinguish the consent materials from other online study processes; and valued getting access to testing in the study. Overall, conducting empirical bioethics research in an ongoing clinical trial was useful to demonstrate the acceptability of our novel consent approach but posed practical challenges. (shrink)

State Medical Boards (SMBs) can take severe disciplinary actions (e.g., license revocation or suspension) against physicians who commit egregious wrongdoing in order to protect the public. However, there is noteworthy variability in the extent to which SMBs impose severe disciplinary action. In this manuscript, we present and synthesize a subset of 11 recommendations based on findings from our team’s larger consensus-building project that identified a list of 56 policies and legal provisions SMBs can use to better protect patients from egregious (...) wrongdoing by physicians. In recent years, feminist scholarship on emotional labor has proliferated. I identify a related but distinct form of care labor, hermeneutic labor. Hermeneutic labor is the burdensome activity of: understanding and coherently expressing one’s own feelings, desires, intentions, and movitations; discerning those of others; and inventing solutions for relational issues arising from interpersonal tensions. I argue that hermeneutic labor disproportionately falls on women’s shoulders in heteropatriachal societies, especially in intimate relationships between women and men. I also suggest that some of (...) the gendered burdens of emotional labor that feminist scholars point out would better be described as hermeneutic labor. Drawing on feminist philosophy as well as findings from social psychology and sociology, I argue that the exploitation of women’s hermeneutic labor is a pervasive element of what Sandra Bartky calls the ‘micropolitics’ of intimate relationships. The widespread expectation that women are relationship maintenance experts, as well as the prevalence of a gendered demand-withdraw pattern of communication, leads an exploitative situation to appear natural or even desirable, even as it leads to women’s dissatisfaction. This situation may be considered misogynistic in Kate Manne’s sense, where misogyny is a property of social environments rather than a worldview. (shrink)

SeitzThe Society for Buddhist-Christian Studies (SBCS) is one of more than two dozen scholarly societies that have been formally recognized by the American Academy of Religion as Related Scholarly Organizations. The pattern for many years has been for the SBCS to hold its annual meeting in conjunction with the annual meeting of the AAR. On (...) the Friday before the AAR’s Annual Meeting begins, the Society’s board meets in the morning and early afternoon, followed by an AAR-advertised session late that afternoon. On Saturday, another paper session or panel is followed by the Society’s annual members’ meeting.A highlight of the 2012 SBCS annual meeting was the unanimous approval, first by the governing board and later by the membership in attendance, of a major revision of the society’s bylaws. This revision focused largely on updates necessitated by changes in the ways scholars communicate day-to-day and in scholarly publications, and in international banking practices, because of the expanding use of electronic media. This revision was well over a year in the making, with particularly generous input of time and thought by former board member Grace Burford and Treasurer Guy McCloskey, and with efficient guidance by President Terry Muck.Another highlight of this 2012 gathering was the announcement at the board meeting that the SBCS’s reapplication for formal status as a Related Scholarly Organization of the AAR was accepted for another five years. This paper elicits a twentieth‐century American story that is deeply rooted in the legacy of American philosophical pragmatism, its impact on a particular school, and its reconstruction of American theology. The paper focuses on three generations of American theologians, and it centers on how these theologians reconstruct theology in light of the science of their day and how they maintain a true plurality of insights about human life in the world. The pragmatic theologian regards the creative exchange between theology and (...) natural science as an opportunity for renewing our understanding of religious life and appreciating the various commitments of scientists and theologians as they meet at the juncture of human interests. The first voice is that of the early Chicago School of Theology represented by Shailer Mathews, Gerald Birney Smith, and George Burman Foster. Educational theory does not oppose educational practice, as manyseem to think; instead it is a form of practice and the action oftheory exists at two levels. At a cultural level theory ischaracterized by linguistic forms of action and at a social level it is characterized by the day to day practices thatorganize and reward the work of producing educational philosophy.While the social practices that govern the production ofphilosophy certainly beg for ethnographic attention,any consideration anthropologists or philosophers giveit will eventually find (...) its way to the page and hence tothe cultural forms of linguistic action that are thesubject of this paper. Focusing on how educationalphilosophers see the things that they do, as opposedto what they see, I will suggest that the wayeducational philosophy is fashioned is an importantpart of what is fashioned. Ironically, as I will show,the ``way'' of educational philosophy can flow with oragainst the ``what'' of it – an author, that is, can saythat they are for or against this or that, but their stylized way of saying it can contradict the literalmeaning of their words. Résumé Les discussions contemporaines du concept fécond de forme de vie ont permis de mettre en évidence à quel point le concept de forme lui-même est essentiel chez Wittgenstein, structurant la continuité entre le premier et le second Wittgenstein. En passant de la « forme logique » au concept de forme de vie, Wittgenstein entend renoncer à une unité « de forme » pour passer à une « famille » de structures apparentées. Mais la logique ne disparaît pas – au (...) contraire. Le point sur lequel s’appuie sa recherche reste bien la forme, entendue désormais comme pluralité de façons pour le langage de décrire le réel. Molinism attempts to resolve the incompatibility of divine foreknowledge and human libertarian freedom by the inclusion of the divine will into the solution. Moreover, middle knowledge is providentially useful under the Molinist model because of the way God uses it. This speaks of an integral link between the divine will and intellect that works in such a way as to provide a foreknowledge solution and, allegedly, the best view of providence. Nevertheless, there have been several anti-Molinist arguments by analogy which (...) suggest that the God presented in the Molinist model is a manipulator, and therefore something is lost or undermined in the libertarian freedom that Molinism purports to uphold through its model of foreknowledge and providence. This thesis examines the anti-Molinist charge of manipulation primarily by analysing how God uses information known through middle knowledge. The findings of the anti-Molinist arguments from analogy are reconstructed to form deductive arguments. These are evaluated against standard definitions of objectionable manipulation. It is concluded through analysis of these stronger, deductive arguments that divine providence under the Molinist model is a case of objectionable manipulation, one which many theists, classical or progressive, should find abhorrent. The effects of manipulation on ostensible libertarian freedom are then analysed, leading to the conclusion that Molinist-style manipulation results in a form of free-will compatibilism, ergo, the divine foreknowledge problem is not answered, nor is the result compatible with libertarian freedom. Given that it is close to a form of divine determinism, Molinism is then compared with Calvinism along several lines of criticism, namely whether such a God is good, loving and personal. (shrink)

Law wrangles with setting and applying standards for the practice of medicine in many different arenas. One of the most prominent is medical malpractice litigation in which the trial process examines a physician's performance and measures it against the standard of care. The profession's prevailing custom, with some substantial tolerance for “respectable minority” views, has been the gold standard for scrutinizing physician practice and treatment decisions in the malpractice context. Using the profession's custom as the measure against which a physician's (...) performance is judged defers to the expertise of medicine. Deference to the medical profession is attractive as a tool for reining in law. Reliance on customary practice is criticized, however, for driving physicians to the relative safety of the middle of the herd. Creating such a strong incentive for compliance with customary practice can dampen medical innovation and the diffusion of new clinical knowledge. The safety of the herd can also deprive individual patients of the best care in their particular circumstances.Several current trends are strengthening claims that professional practice patterns are an inappropriate tool for distinguishing between high‐quality and substandard care. In particular, advocacy for evidence‐based medicine aggressively asserts that the traditional way of making medical treatment decisions is largely untethered from scientific method or data, rendering professional judgment, even in the aggregate, suspect.
